Terms of Service

  1. Terms of Service

§.1 General Provisions

  1. These Terms of Service define the rules for using the Grupa Biwakowa mobile application and the website available at www.grupabiwakowa.pl, hereinafter referred to as the „Service”.
  2. The Service is operated by Patron, ul. Rodzinna 9/13 53-029 Wrocław, NIP: 577-167-37-39, REGON: 931989846, hereinafter referred to as the „Operator”.
  3. Using the Service constitutes acceptance of these Terms of Service.
  4. The Service enables users in particular to:
  • browse camping spots,
  • publish places, comments and photos,
  • use map features,
  • use user account features,
  • use additional features within a premium account.

§.2 Definitions

For the purposes of these Terms of Service, the following definitions apply:
  • Service – the Grupa Biwakowa mobile application and website.
  • User – a natural person using the Service.
  • Account – an individual user account within the Service.
  • Premium Account – an optional, paid extension of the user account that unlocks additional features.
  • Operator / Web Seller – Patron, ul. Rodzinna 9/13, 53-029 Wrocław, NIP: 577-167-37-39; the entity providing the Service and selling the Premium Account via the Website.
  • Publisher – Marcin Wasilewski, ul. Powstańców Wlkp. 10/8 61-895 Poznań, NIP: 783-167-39-75; the entity publishing the Application on Google Play and the Apple App Store.
  • Store – the application distribution platform: Google Play (Google Ireland Ltd.) or the Apple App Store (Apple Distribution International Ltd.) through which in-app purchases are made; with respect to such purchases, the Store is the seller to the User and the issuer of the proof of sale.
  • Payment Provider – Stripe Payments Europe, Ltd. (Ireland) together with its affiliates – the provider handling payments for purchases made via the Website.
  • Subscription – paid, automatically renewing access to the Premium Account for a fixed term (the Billing Period).
  • Billing Period – the period for which a fee is charged (e.g. one month or one year).
  • Consumer – a natural person making a purchase for purposes not directly related to their business or professional activity; Entrepreneur – a User who is not a Consumer.
  • Premium Account – a paid extension of the Application's functionality, offered in packages: "premium" (access to the Application) and "premium with card" (access to the Application together with a virtual Grupa Biwakowa card). Both packages constitute a digital service/digital content – they do not include the delivery of any physical item.

§.3 User Account

  1. Use of certain Service features requires creating an Account.
  2. The user may create an Account via:
  • registration using an email address and password,
  • login using external providers (Google, Facebook, Apple).
  1. The user is responsible for the security of their Account.
  2. The user agrees not to share their Account with third parties.
  3. The user may delete their Account at any time from within the application or by contacting the Operator.
  4. The Operator may suspend or delete a User's Account in case of a violation of these Terms of Service.

§.4 Premium Account and Payments

  1. The Premium Account is paid and constitutes an optional extension of the Application's functionality. The current packages, prices (including VAT), currency and Billing Period are presented to the User before the contract is concluded.
  2. Purchases via the Website
    • The seller is the Operator. Payments are processed by the Payment Provider (Stripe); the Operator does not store payment card data. The Operator issues a proof of sale (invoice) based on the data provided by the User. A Subscription purchased via the Website renews automatically for successive Billing Periods until cancelled. The User may cancel the renewal in the Account panel on the Website or by contacting the Operator at biuro@grupabiwakowa.pl; cancellation stops further charges, and premium access remains active until the end of the paid Billing Period.
  3. In-app purchases (Google Play / Apple App Store)
    • The seller to the User and the issuer of the proof of sale is the relevant Store, in accordance with its terms. The terms of payment, renewal, subscription cancellation and refunds are governed by the rules of the given Store; cancellation is performed in the User's account settings within the Store. The Operator/Publisher does not intermediate in these payments and does not process the User's payment data. The technical handling of in-app subscriptions (purchase validation, subscription status) is supported by an external provider (RevenueCat); this does not affect the fact that the seller remains the relevant Store.
  4. Invoices
    • For purchases via the Website, the Operator issues an invoice in electronic form. A User who is an Entrepreneur may provide a tax ID (NIP) for the invoice before making the payment. For in-app purchases, the proof of sale is issued by the relevant Store.

§.5 Right of withdrawal (Consumer)

  1. A Consumer who has concluded a contract for the supply of digital content or a digital service via the Website may withdraw from it within 14 days of concluding the contract, without giving any reason, by submitting a statement to the Operator (e.g. to biuro@grupabiwakowa.pl).
  2. The right of withdrawal does not apply if the Operator has commenced performance (made the Premium Account available) with the Consumer's prior express consent given before the expiry of the withdrawal period and after the Consumer has been informed of the loss of the right of withdrawal – the Consumer acknowledges this during the ordering process.
  3. If the Consumer has not given the consent referred to in paragraph 2, access to the Premium Account is granted after the withdrawal period expires or after effective withdrawal from the contract within that period.
  4. In the event of effective withdrawal, the contract is deemed not to have been concluded, and the Operator refunds the payment received within 14 days.
  5. In-app purchases: refund and cancellation terms are governed by the relevant Store.

§.6 Complaints and conformity of the digital service

  1. The Operator is obliged to provide a Premium Account that conforms to the contract. The conformity of digital content and services with the contract and the Operator's liability are governed by the provisions of the Consumer Rights Act.
  2. Complaints regarding purchases made via the Website should be sent to biuro@grupabiwakowa.pl. The Operator will consider a complaint within 14 days of receipt.
  3. Complaints regarding in-app purchases are handled by the relevant Store in accordance with its rules.

§.7 Location Data

  1. The Service may use the User's location data for the purpose of:
  • displaying the User's position on the map,
  • displaying nearby places,
  • enabling the addition of new places,
  • saving login session information for premium account users,
  • improving Service performance and displaying advertisements.
  1. Location data is processed in accordance with the Privacy Policy.

§.8 User Content Publishing

  1. The user may publish content, including:
  • places,
  • comments,
  • photos,
  • descriptions.
  1. The user bears full responsibility for the content they publish.
  2. It is prohibited to publish content that is:
  • unlawful,
  • infringing on the rights of third parties,
  • infringing on copyright,
  • offensive or misleading.
  1. The Operator has the right to remove content that violates the Terms of Service.

§.9 License on User Content

  1. By publishing content in the Service, the User grants the Operator a non-exclusive, royalty-free, perpetual and worldwide license to use it for the purpose of providing and developing the Service.
  2. The license includes in particular the right to:
  • store content,
  • display content,
  • process content as part of the Service's operation.
  1. The user retains copyright to their content.

§.10 User Liability

  1. The user is responsible for their actions within the Service.
  2. The user agrees not to take actions that could disrupt the operation of the Service.
  3. The user agrees not to exploit Service errors for personal gain.

§.11 Operator Liability

  1. The Operator is not liable for content published by Users.
  2. The Operator does not guarantee the accuracy, completeness or timeliness of information published by users.
  3. The Operator does not guarantee the safety or legality of places published by users.
  4. The user uses information available in the Service at their own risk.
  5. The Operator exercises due diligence to ensure the proper functioning of the Service but does not guarantee its continuous availability or freedom from errors.
  6. The Operator is not liable for damages arising from the use of the Service, except in cases required by law.

§.12 Advertisements

  1. The Service may display advertisements provided by third parties.
  2. Advertisements may be displayed using technical data and device identifiers.
  3. Detailed information is available in the Privacy Policy.

§.13 Intellectual Property

  1. The Service and its elements are the property of the Operator or its partners.
  2. It is prohibited to copy, modify or distribute the Service without the Operator's consent.

§.14 Personal Data Protection

  1. Personal data is processed in accordance with the Privacy Policy.
  2. The user has the right to access, correct and delete their data.

§.15 Changes to the Terms of Service

  1. The Operator may amend these Terms of Service.
  2. The user will be informed of changes.
  3. Continued use of the Service constitutes acceptance of the changes.

§.16 Governing Law

  1. Matters not regulated by these Terms are governed by Polish law.
  2. Any disputes are resolved by the court having jurisdiction under applicable law. In the case of a Consumer, jurisdiction is determined by the general provisions.
  3. A Consumer may use out-of-court methods of handling complaints and pursuing claims, including the European Commission's ODR platform available at https://ec.europa.eu/consumers/odr.
